Terms of Service

In short: TripSphere is a personal travel log. You own your content. You are responsible for what you upload. The app is provided as-is. Do not use it for illegal or abusive purposes. Full rules below.

These Terms of Service ("Terms") are a binding agreement between you and Kaylen Stroeken, trading as TripSphere ("we", "us", "TripSphere"), governing your access to and use of the TripSphere mobile application, website and related services (together, the "Service"). By installing, accessing or using the Service, including creating an account or tapping “I agree”, you accept these Terms. If you do not agree, do not use the Service.

1. The Service

TripSphere is a personal travel archive: trips, photos, GPX routes, distances and related stats on your device. Optional features may include cloud sync, accounts and social features (friends, feed, likes, comments). Offline use without an account is supported. We may change, suspend or discontinue any part of the Service at any time, with or without notice, including for maintenance, abuse prevention or product changes.

The Service is a hobby / personal logging tool. It is not a navigation system, emergency service, medical device, insurance product, or professional travel advice. Do not rely on distances, maps, GPX tracks or stats for safety-critical decisions.

2. Eligibility and accounts

You must be at least 16 years old (or the higher digital-consent age in your country) to create an account. By creating an account you confirm that you meet this requirement. Accounts are personal; you may not share login credentials or create accounts for others without permission.

You are responsible for all activity under your account and for keeping credentials secure. Notify us promptly at support@tripsphere.eu if you suspect unauthorised access. We may refuse, suspend or terminate accounts that violate these Terms or create risk for us or other users. You may delete your account at any time in the app or via our account deletion page.

3. Your content — ownership and licence

You retain ownership of trips, photos, text, GPX files, comments and other material you submit ("Your Content"). You are solely responsible for Your Content.

You represent and warrant that: (a) you own Your Content or have all rights needed to use and share it; (b) Your Content does not infringe any third-party rights (including copyright, trademark, privacy, publicity); (c) if Your Content depicts other people, you have any consent required by law; (d) Your Content is accurate to the best of your knowledge where presented as fact.

By uploading or syncing content, you grant TripSphere a limited, worldwide, non-exclusive, royalty-free, transferable licence to host, store, reproduce, process, display and transmit Your Content solely to operate, secure and improve the Service for you and for recipients you choose to share with. This licence ends when you delete the content or your account, except for: residual copies in backups purged on a rolling schedule; content already lawfully shared with others under your settings; and copies we must keep for legal or security reasons.

4. Acceptable use

You must follow our Community Guidelines. Without limitation, you agree not to:

There is zero tolerance for abusive users or objectionable content. We may remove content, restrict features, suspend or permanently ban accounts, and report illegal activity to authorities, without prior notice where we reasonably believe it is necessary.

5. Moderation, reporting and notices

Where social features exist, we aim to offer report and block tools. We endeavour to review reports and take appropriate action (including removing content and suspending accounts) within 24 hours where reasonably possible. Report abuse, illegal content or copyright concerns to support@tripsphere.eu with enough detail to locate the material (URLs, usernames, screenshots if available). We may act on clear violations we discover ourselves.

We are not obliged to pre-screen all content. Availability of moderation tools does not make us the publisher of Your Content or of other users’ content for liability purposes, except where mandatory law says otherwise.

6. Our intellectual property

The Service, including software, design, logos, trademarks and documentation, is owned by Kaylen Stroeken / TripSphere or its licensors. Except for the limited right to use the Service under these Terms, no rights are granted. You may not copy, modify, distribute, sell, lease, reverse-engineer or create derivative works of the Service except as mandatory law allows.

Feedback, ideas or suggestions you send us may be used by us without restriction or compensation; you grant us a perpetual, worldwide, royalty-free licence to use them.

7. Third-party services

Optional features rely on third parties (for example Supabase for auth/storage, Sentry for crash diagnostics, and Apple/Google/Expo for push delivery). Their terms and privacy policies apply to their processing. We are not liable for third-party outages, data handling by those providers beyond our instructions, or changes they make, except where mandatory law requires otherwise.

8. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT DATA (LOCAL OR CLOUD) WILL NEVER BE LOST, CORRUPTED OR DELAYED.

You are solely responsible for backing up important trips and photos. Distances, routes and stats may be approximate or based on user-imported files; we do not guarantee their accuracy.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE (AND OUR SUPPLIERS) ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF: (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM; OR (B) €0 IF THE SERVICE WAS PROVIDED FREE OF CHARGE.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be limited under Belgian or applicable EU consumer law. If you are a consumer in the EU/EEA/UK, you keep mandatory statutory rights that cannot be waived.

10. Indemnity

To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless Kaylen Stroeken / TripSphere from and against claims, damages, losses, liabilities and expenses (including reasonable legal fees) arising out of: (a) Your Content; (b) your use of the Service; (c) your breach of these Terms; or (d) your violation of any law or third-party rights. We may assume exclusive defence of any matter subject to indemnity; you will cooperate reasonably.

11. Privacy

Personal data is handled as described in our Privacy Policy, which forms part of how we operate the Service.

12. Termination

You may stop using the Service at any time and delete your account. We may suspend or terminate access immediately if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends. Sections that by nature should survive (including ownership, licences for residual copies, disclaimers, limitation of liability, indemnity, and governing law) survive termination.

13. Changes

We may update these Terms. We will revise the date at the top and, for material changes, notify you in the app or by other reasonable means where practical. Continued use after the effective date constitutes acceptance, except where mandatory law requires a different process.

14. Governing law and disputes

These Terms are governed by the laws of Belgium, excluding conflict-of-law rules. Courts of Belgium have jurisdiction, without prejudice to mandatory consumer protections and forum rights in your country of residence (including EU consumer rules). Before filing a claim, you agree to try to resolve disputes informally by emailing us; we will attempt good-faith resolution within 30 days.

15. General

These Terms are the entire agreement between you and us regarding the Service and supersede prior agreements on the same subject. If a provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganisation or transfer of the Service. No third-party beneficiaries except as expressly stated. Headings are for convenience only.
